TERRITORIAL JURISDICTION (13 V.S.A. § 2)
One of the essential
elements which the State must have proven is that the alleged offense occurred
within the State of Vermont. If all of the acts occurred in another state,
then there is no jurisdiction and you must find (Def)_______________
not guilty. However, if
(Def)_______________ intended to commit this crime, and if (Def)_______________
did an act within this state in execution or partial execution of [his] [her]
intent to commit the crime, and if (Def)_______________’s acts within the state
culminated in the commission of the crime either inside
or outside the state, then you may find (Def)_______________ guilty of the
crime in the same manner as if [he] [she] had committed the crime entirely
within the state.
