CR07-403 06/18/03
ENTRAPMENT
(Def)_______________ alleges that [he] [she] was entrapped.
If (Def)_______________ had no previous intent or purpose to violate the law, but was induced or persuaded by law enforcement officers to commit a crime, then (Def)_______________ was legally entrapped, and the law forbids a criminal conviction in such a case.
On the other hand, if (Def)_______________ was ready and willing to break the law, and the government agents merely provided what appeared to be a favorable opportunity, then it was not entrapment.
If you find beyond a reasonable doubt that, before anything at all occurred respecting the alleged offense involved in this case, (Def)_______________ was ready and willing to commit the crime of _______________, whenever the opportunity was afforded, and that police officers did no more than provide the opportunity, then you should find that (Def)_______________ was not entrapped.
On the other hand, if you have a reasonable doubt whether (Def)_______________ had the previous intent or purpose to commit the alleged offense, apart from the inducement or persuasion of the officer, then you must find (Def)_______________ not guilty.
