Superior Court Oversight Committee Recommended Foreclosure Forms

The Superior Court Oversight Committee seeks to make available to attorneys five recommended forms related to foreclosure practice.  These have been developed through an 18-month project with substantial and much-appreciated input from attorneys.  These forms are now being encouraged by the Committee and Superior Court Judges and Clerks in an effort to update and standardize foreclosure practice throughout the State.  They are:

 

  1. A form of judgment for use in judicial sale foreclosures (pdf format) (word format)
  2. A form of judgment for use in strict foreclosures (pdf format) (word format)
  3. An attorney’s confirmation checklist (a tool to determine if prerequisites to confirmation are met) (pdf format) (word format)
  4. A form of motion for confirmation (pdf format) (word format)
  5. A form of confirmation order (pdf format) (word format)

The Committee strongly encourages attorneys to use these standard forms.  With respect to the judgment orders to be issued by the court, where attorneys wish to include supplemental or different terms, it would be much appreciated if they submit both a proposed version for signature, and a “red-line” or “track changes” version, so that the judge will be able to quickly compare what has been submitted with the standard form.  This will significantly improve the court’s ability to provide orders without delay.
